Terms of service

These terms are an agreement between Winky ("we") and the merchant who installs Winky Popups on their Shopify store ("you"). By approving Winky's plan in Shopify, or by using the app, you agree to them and to our privacy policy.

The service

Winky shows popups and prize games on your online store, creates the Shopify discount codes you choose for winners, and reports the orders and sales your popups bring in. You decide what each campaign says, which prizes it offers and who sees it, and you are responsible for honouring the discounts your campaigns give out.

Price

The price is the one shown in the app and on our Shopify App Store listing, and is charged by Shopify on your Shopify bill. If we change it, we will tell you in the app at least 30 days before, and Shopify will ask you to approve the new price.

Data protection

For information about your customers and store visitors, you are the controller and Winky acts on your behalf as your processor. We will:

• process it only to provide Winky as described in the privacy policy, and never sell it, use it for advertising or share it with other merchants;
• process the minimum needed: no names, email addresses, phone numbers or addresses;
• respect each shopper's privacy choices on your store, and keep nothing on their device when they have not allowed it;
• keep it confidential, limit access to the people who run Winky, and protect it with encryption in transit and at rest;
• use only Shopify and Google Cloud (our hosting provider) to store and process it;
• help you answer your customers' requests to see or delete their information, which Shopify passes to us automatically;
• tell you without undue delay, and within 72 hours, if we learn of a breach affecting it;
• delete it when you uninstall Winky, as Shopify asks us to, or sooner if you ask us.

You are responsible for having a lawful basis to collect your customers' information and for your store's own privacy policy and consent settings.

Acceptable use

Don't use Winky to mislead shoppers, run games that are illegal where you sell, or interfere with the service. We may suspend an account that does.

Availability and liability

We work to keep Winky running and correct, but provide it "as is". To the extent the law allows, our total liability is limited to the fees you paid us in the 3 months before the claim, and we are not liable for indirect losses such as lost profits.

Ending

You can cancel the plan in Settings or uninstall Winky at any time. Cancelling pauses your live campaigns and stops all charges. Fees already billed by Shopify are not refunded.

Changes

If we change these terms, we will update this page and the date above, and tell you in the app about any change that affects you.
